If you or a loved one has been injured in an accident that resulted from the negligence or fault of another, please seek out medical attention, and then call us immediately.

If you are involved in an automobile accident New York State Law requires that your medical bills, lost wages, and other necessary expenses be paid pursuant to the New York State No Fault Law. That same law requires that a No Fault application be filed within thirty (30) days of the accident. Failure to provide the application in a timely fashion can lead to the denial of benefits.

We, at Riconda & Garnett, LLP, focus our attention on obtaining, completing and filing the no fault application while identifying the insurance carrier for the offending vehicle. By appropriate filing of the no fault application and disability form, we try to assure the prompt payment of lost wages and medical expenses.

If we are retained by you, it is our expectation that all contact with insurance companies, towing companies and/or medical bill collectors will be handled by this office. We believe that following an accident your sole obligation should be to treat effectively for the injuries you have sustained.

If you have been injured in a trip/fall accident it is imperative that we identify the municipality and/or the land owner responsible for maintaining the accident sites. It is often true that a land owner's insurance carrier would provide up to Five Thousand ($5,000.00) Dollars for payment of medical bills. It is important that such "med pay" demands be made in a timely fashion.

When suing a municipality it is necessary to file a Notice of Claim, identifying the details of the accident and the injuries sustained "usually" within ninety (90) days. Failure to serve such a notice on a municipality can be fatal to the claim.

Until recently there was an epidemic of infant lead poisoning cases in the City of New York and surrounding counties. By ingesting lead usually paint chips children can sustain debilitating neurological injuries. Depending upon your address, landlords and/or municipalities have an obligation to advise you of lead paint threats.

If your child has ingested paint chips and/or has exhibited neurological symptoms, please immediately take the child to a doctor or hospital for testing. Thereafter, please call our office for a consultation.
